Terms of Service

Effective 28 July 2026. These terms govern your use of Gorgon Training: the platform at training.gorgoncyber.com, its supporting services, and the training content delivered through it (together, the "Service"), operated by Gorgon Cyber Pty. Ltd. By creating an account or enrolling anybody you agree to these terms. If you do not agree, do not use the Service.

1. Who These Terms Are With

The account belongs to an organisation, not to an individual. If you accept these terms, you confirm you are authorised to bind that organisation. Where these terms say "you", they mean the organisation. Employees enrolled in training are covered by these terms through their employer, and are not separately liable under them.

2. What the Service Does

The Service assigns training to a person based on their role and your organisation's circumstances, delivers that training, tests understanding with quizzes, and records what was completed. Assignment is proposed by an automated system that selects from our published catalogue. It is a recommendation. Your administrators review it, can add or remove classes, and can switch individual courses off before anybody is enrolled. What a person is finally assigned is your decision, not ours.

5. Subscription, Seats, and Billing

Gorgon Training is USD 10 per trainee per year.

Payment is processed by Stripe. We do not see or hold your card details.

6. Late Payment

If a payment fails we will tell you and keep trying, with reminders, for 30 days. During that time everything keeps working. If it is still unresolved at the end of that period, administration of the account is paused: your administrators can no longer enrol people or change settings. Trainees part way through their training keep their access throughout, and no records or certificates are deleted. Updating your card restores everything immediately.

7. Cancellation

You may cancel at any time from your own billing settings. Cancellation takes effect at the end of the year you have already paid for, not immediately: that year has been bought and the people mid-way through their training keep it. You can reverse a cancellation any time before it takes effect. We do not refund the unused part of a year. When the subscription ends, your records and certificates remain and the account returns to the free trainee allowance.

8. Complimentary Accounts

We may mark an account as complimentary, which means it is not charged. That is a decision we make and can reverse on notice. Everything else in these terms applies to a complimentary account.

9. Training Records and Certificates

Completion records and certificates are yours, and we will keep them available while your account is open. A certificate records that a named person completed a named class on a date, and carries a code anyone can use to verify it. It is evidence of completion of our training. It is not an accreditation, a qualification, or a certification issued by any standards body or regulator, and it does not certify a person as competent.

10. Compliance Is Yours

Our content is written to be useful and to map onto common security and privacy obligations, but training is one input into your compliance position and not a substitute for advice. We do not warrant that completing any part of the Service satisfies any specific legal, regulatory, contractual, or certification requirement that applies to your organisation. Deciding what your obligations are, and whether this training meets them, is yours. Nothing in the Service is legal advice.

11. Intellectual Property

The Service, the training catalogue, the videos, the assessments, and all related materials are the intellectual property of Gorgon Cyber Pty. Ltd. Your subscription gives you a non-transferable, non-exclusive, revocable licence to use them to train your own people for the term of your subscription. All rights not expressly granted are reserved. Your own data, including your settings, your people's records, and your certificates, remains yours.

12. Service Changes

We may change the Service and add, revise, or retire content at any time. Training already under way is pinned to the version of the catalogue it started on, so a content change never rewrites an enrolment somebody is part way through.

13. Availability

We aim to keep the Service available and to give notice of planned interruptions, but we do not offer a service level agreement or an uptime guarantee at this price. Deadlines you set for your people are yours to manage, and we will extend them where an outage of ours has made them unfair.

14. Termination

We may suspend or terminate an account, with or without notice, if we reasonably believe you have breached these terms, abused the Service, or used it unlawfully. You may stop using the Service at any time by cancelling. On termination we will, on request, provide an export of your training records before deleting your data.

15. No Warranty

The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, Gorgon Cyber Pty. Ltd. makes no warranty that the Service will be error-free or uninterrupted, that the training assigned to any person is the right training for them, that any defect will be corrected, or that training will change anybody's behaviour. Nothing in these terms excludes rights under the Australian Consumer Law that cannot lawfully be excluded.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Gorgon Cyber Pty. Ltd. will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with the Service, including lost profits, lost data, regulatory penalties, or the consequences of a security incident. Our aggregate liability for any claim arising out of these terms or the Service will not exceed the amount you paid us in the twelve months preceding the claim.

17. Indemnity

You agree to indemnify and hold Gorgon Cyber Pty. Ltd., its directors, officers, employees, and agents harmless from any claim, liability, damage, or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the Service, or your providing us with personal information you were not entitled to provide.

18. Privacy

Our handling of personal information is set out in the Gorgon Training privacy policy, which forms part of these terms. For your employees' information you are the controller and we are your processor.

19. Governing Law

These terms are governed by the laws of Victoria, Australia. Any dispute arising out of or in connection with these terms or the Service will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

20. Changes to These Terms

We may update these terms as the Service develops. Material changes will be notified to account administrators before they take effect. Continued use after they take effect constitutes acceptance.
